These Service Terms are part of Your Terms with Walter Software Corporation ("Walter"). Any capitalized terms used but not defined in these Service Terms have the meaning set forth in the Terms. In any situation in which there is a conflict between these Service Terms and the Terms, these Service Terms control with respect to features and services governed by these Service Terms.
1. Beta features
1.1 This Section 1 governs Your use of services or features that Walter offers on a preview, beta, or early access basis ("Beta Features") and that you elect to use.
1.2 Any Feedback related to the Beta Features may be used to improve the Service.
1.3 Beta Features are offered on an as-is and as-available basis. Your access to or use of Beta Features is at your own risk.
1.4 To the extent permitted by law, Walter expressly disclaims all, and You receive no, warranties and conditions of any kind, whether express or implied, including but not limited to, those of merchantability, satisfactory quality, title, fitness for a particular purpose, and non-infringement.
1.5 To the extent allowed by applicable law, Walter’s liability to You with respect to Beta Features is limited to $100.
1.6 Unless indicated otherwise in these Service Terms, Beta Features will be metered and billed as normal usage of the Service.
1.7 Walter may materially change Beta Features during the course of the preview and may opt to discontinue Beta Features.
2. Data storage
2.1 You acknowledge that any election by You to store Customer Data or Content outside the primary location for your selected data processing region may affect performance and availability of the Services. Modern platforms depend on third party sub processors and the sub-processors deployments performance, features and quality can vary by region.
2.2 Notwithstanding anything set forth in the Terms, Your workspace retention setting will not apply to certain features, as outlined in our Documentation.
3. Context sources
3.1 “Context Sources” refers to additional sources of context that a user may enable and use within the Service for the Service to ask questions of, such as, but not limited to, web browsing, document management systems (DMS), and other API integrations.
3.2 Content may contain portions of the Customer Data or portions of data from Context Sources. IP ownership of such portions of Customer Data or data from Context Sources is not impacted by its use in the Services.
3.3 Context Sources are features that may be leveraged in various parts of the Service to enhance the user’s experience by directly querying the internet or other enabled Context Sources.
3.4 When Context Sources are used by the Customer, links to relevant URLs (where applicable) may be returned to the user with the Output.
3.5 Walter may engage multiple Subprocessors, listed on the Subprocessor List, to help provide Context Sources.
3.6 Such Subprocessors may process Customer Data and Content in the location(s) specified on https://getwalter.com/legal/subprocessors and may not process in your selected data processing region. Customers will have the choice to opt out of certain Context Sources.
3.7 Context Sources may not be HIPAA compliant. You should use caution before using Context Sources, including by not uploading or processing Protected Health Information through Context Sources.
4. Sharing of information with context sources
4.1 You acknowledge that information and content that You submit, upload, or otherwise provide to the Services (including Customer Data, Content, and Input) may be shared by the model and/or the Service with Context Sources in order to generate Output.
4.2 You will use discretion and take appropriate steps to protect confidential, privileged, or other sensitive information when using the Services with Context Sources.
