This Acceptable Use Policy (this “AUP”) forms part of Your agreement governing Your use of Walter’s services (the “Agreement”) and applies when you access or use Walter’s services, including any related software, websites, applications, or features (collectively, the “Services”). This AUP forms part of the “Terms” (as defined in the Agreement).
Capitalized terms used but not defined in this AUP have the meanings given to them in the Agreement.
1. Definitions
In this AUP:
1.1 “Input” means any data, content, prompts, documents, or other materials submitted to the Services by you or on Your behalf.
1.2 “Output” means any results, responses, or other outputs generated by the Services based on Input.
1.3 “Privacy Policy” means Walter’s privacy policy, as updated from time to time, located at https://getwalter.com/legal/privacy-policy.
1.4 “You” or “Your” means the customer, user, or entity accessing or using the Services under the Agreement.
2. Your responsibilities
2.1 Account security. You are responsible for keeping Your access credentials (e.g., username and password) safe and confidential.
2.2 Unauthorized access. You must notify Walter immediately if you suspect or discover unauthorized access to, or use of, the Services and/or any access credentials. (Contact: support@getwalter.com.)
2.3 Third-party rights in Input. You are responsible for ensuring that you have the necessary rights, permissions, and consents to use any third-party content included in Your Input.
2.4 Use of Output. You are responsible for evaluating the accuracy of Output and verifying that Your use of Output does not violate any applicable law or third-party rights.
3. Prohibited uses (global policy)
You must not, and must not direct or allow users or third parties to, use the Services to:
3.1 Violate applicable law. This includes using the Services to:
3.1.1 violate, encourage the violation of, or otherwise compromise the privacy or legal rights of others;
3.1.2 infringe, misappropriate, or violate the intellectual property rights of any third party;
3.1.3 identify an individual from biometric data or create a biometric database;
3.1.4 exploit the vulnerabilities of an individual or group of individuals arising from their age, disability, or specific social or economic situation, with the aim of distorting their behaviour in a manner likely to cause them harm;
3.1.5 evaluate or classify individuals based on their social behaviour or personal information; or
3.1.6 characterize individuals (including through social scoring or profiling) in a manner that results in detrimental, unfair, or unfavorable treatment.
3.2 Compromise security or integrity. This includes using the Services to:
3.2.1 intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, malware, or other items of a destructive or deceptive nature;
3.2.2 interfere with the use of the Services, or the equipment used to provide the Services; or
3.2.3 disable, interfere with, circumvent, or attempt to circumvent any aspect of the Services.
3.3 Compete with the Services. Use the Services to build, develop, or improve a product, service, model, or feature that competes with the Services.
3.4 Account sharing / transfer. Transfer Your right to access or use the Services to any third party, or share accounts.
3.5 Reverse engineering. Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of any portion of the Services, except to the extent expressly permitted by applicable law.
3.6 Derivative works. Modify, customize, port, translate, localize, or create derivative works of any portion of the Services.
3.7 Automated extraction / scraping. Use any automated or programmatic method to extract data or Output from the Services, including scraping, web harvesting, or web data extraction.
3.8 Interference / malware. Use the Services in a manner that interferes or attempts to interfere with the proper working of the Services, including by introducing or permitting the introduction of any virus or malware into Walter’s network or information systems.
3.9 Legal advice without human review. Provide legal advice without human review.
3.10 Certain automated decisions. Make automated decisions that have a material or detrimental impact on individual rights without human supervision.
3.11 High-impact decisions. Make decisions, or be a substantial factor in making decisions, about:
3.11.1 access to education and educational opportunities;
3.11.2 employment opportunities; or
3.11.3 an individual’s eligibility or entitlement to legal services or legal representation,
in each case without material human involvement.
4. Processing of personal data
